Dataset offers this website, including all information, tools, and services available on it (the "Service"), to you on the condition that you accept these Terms of Service ("Terms"), along with the policies referenced here: our Privacy Policy, Refunds & Returns Policy, and Limited Warranty.

By visiting the site or buying from us, you agree to these Terms. They apply to everyone who uses the site, including visitors and customers. If you do not agree, do not use the Service.

Our store is hosted on Shopify Inc. Shopify's terms and privacy practices apply to the platform in addition to these Terms.

1. Online store terms

By agreeing to these Terms, you confirm that you are at least the age of majority where you live, or that you are the age of majority and have given consent for any minor dependents to use the site.

You may not use our products or the Service for any illegal or unauthorized purpose, or violate any laws in your jurisdiction, including copyright laws. You must not transmit viruses or any other destructive code. A breach of these Terms may result in immediate termination of your access to the Service.

Purchases are for personal use. We may refuse or cancel orders that appear to be placed by resellers or distributors, or that involve bots, multiple accounts, or other bulk-purchasing methods.

2. General conditions

We may refuse service to anyone for any reason at any time.

Your content, excluding payment card information, may be transferred unencrypted across networks and adapted to technical requirements of connecting networks or devices. Payment card information is always encrypted in transit.

You may not reproduce, duplicate, copy, sell, resell, or exploit any part of the Service without our written permission.

Headings in these Terms are for convenience only and do not affect their meaning.

3. Accuracy of information

Information on this site is provided for general reference and may not always be complete or current. Any reliance on it is at your own risk. The site may contain historical content, which is provided for reference only. We may change the site's content at any time but have no obligation to update it.

4. Changes to the Service and prices

Prices may change without notice. We may modify or discontinue the Service, or any part of it, at any time without notice, and we are not liable to you or anyone else for doing so.

Limited releases, preorders, and collaboration pieces may sell out. Listing an item does not guarantee a restock, and signing up for product alerts or a waitlist does not reserve an item for you.

5. Products

Some products may be available only online and in limited quantities. They can be returned or exchanged only under our Refunds & Returns Policy.

We make every effort to display product colors and images accurately, but we cannot guarantee that your screen displays colors accurately. Pigment-dyed, washed, and discharge-printed garments can vary slightly between production runs. This variation is normal and is not, by itself, a defect.

We may limit sales of any product to any person, region, or jurisdiction, limit quantities, change product descriptions or prices, or discontinue any product at any time. Any offer made on this site is void where prohibited.

Except as stated in our Limited Warranty, we do not warrant that any product will meet your expectations or that any errors in the Service will be corrected.

6. Orders, billing, and account information

We may refuse or cancel any order, and may limit quantities per person, household, or order. This includes orders placed under the same account, payment card, or billing or shipping address. If we change or cancel an order, we will try to notify you using the contact details provided with the order.

You agree to provide current, complete, and accurate purchase and account information, and to update it promptly so we can complete your transactions and contact you.

7. Third-party tools

We may provide access to third-party tools that we do not monitor or control. These tools are provided "as is" and "as available," without warranties or endorsement, and your use of them is at your own risk and subject to the provider's terms. We have no liability arising from your use of third-party tools.

New features or tools added to the site are also subject to these Terms.

8. Third-party links

The Service may include links to third-party websites and materials, such as Spotify, Apple Music, Mixcloud, and Instagram. We are not responsible for their content, accuracy, products, or practices, and have no liability for any transaction you make with a third party. Direct any questions or complaints about third-party products to the third party.

9. Submissions and feedback

If you send us ideas, suggestions, proposals, or other materials, whether we requested them or not ("Submissions"), you agree that we may use, edit, copy, publish, distribute, and translate them in any medium without restriction. We have no obligation to keep Submissions confidential, pay for them, or respond to them.

You agree that your Submissions will not violate any third party's rights, including copyright, trademark, privacy, or personality rights, and will not contain unlawful, abusive, or obscene material or malicious code. You may not use a false email address or misrepresent who you are. You are solely responsible for your Submissions. We may, but are not obligated to, monitor, edit, or remove content we consider unlawful, offensive, or in violation of these Terms.

Your submission of personal information through the store is governed by our Privacy Policy.

11. Errors and omissions

The site may occasionally contain errors, inaccuracies, or omissions relating to product descriptions, pricing, shipping charges, transit times, or availability. We may correct them, update information, or cancel orders at any time without notice, including after you have placed an order.

If a product is listed at an incorrect price, we may cancel the order and refund you in full, even after you have received an order confirmation.

We have no obligation to update or clarify information on the site, except as required by law.

12. Prohibited uses

In addition to the other restrictions in these Terms, you may not use the site or its content:

• For any unlawful purpose, or to encourage others to act unlawfully
• To violate any law, regulation, or ordinance

Dataset and related marks are trademarks of Dataset.

You may not copy, scrape, reprint, or commercially use our artwork, product photography, or marks without written permission. Buying a product does not give you ownership of its artwork or any right to reproduce it on other products, digital goods, or another brand.

If you believe content on the site infringes your copyright, email info@feeldataset.com with:

• Your contact information
• A description of the copyrighted work
• The URL of the allegedly infringing material
• A statement that you believe in good faith the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf
• Your physical or electronic signature

14. Shipping, duties, and risk of loss

Title and risk of loss pass to you when we hand the package to the carrier, except where consumer law in your country says otherwise. Tracking is provided when the carrier supplies it.

For international orders, you are the importer of record and are responsible for customs duties, taxes, and brokerage fees unless we state otherwise at checkout. If a package is refused at customs or returned for unpaid duties, we may refund the product price minus original shipping and any carrier return fees.

We are not responsible for delays caused by carriers, weather, strikes, or customs. If a domestic package shows as delivered but you have not received it, contact the carrier first, then email info@feeldataset.com within 7 days, with photos of the delivery location if possible. We will help you file a claim, but replacement is not automatic.

15. Disclaimer of warranties and limitation of liability

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results obtained from it will be accurate or reliable. We may suspend or discontinue the Service at any time without notice.

Your use of the Service is at your own risk. Except as stated in our Limited Warranty, the Service is provided "as is" and "as available." Implied warranties on products, including merchantability and fitness for a particular purpose, are limited to the duration of the Limited Warranty, to the extent permitted by law.

To the maximum extent permitted by law, Dataset and its owners, employees, agents, contractors, suppliers, service providers, and licensors are not liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, or loss of data. This applies whether the claim is based in contract, tort (including negligence), strict liability, or otherwise, and even if we were advised of the possibility of such damages.

Where a limitation of liability is allowed, our total liability for any claim relating to an order will not exceed the amount you paid for the product at issue. Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, our liability is limited to the maximum extent the law permits.

16. Indemnification

You agree to indemnify, defend, and hold harmless Dataset and its owners, employees, agents, contractors, suppliers, service providers, and licensors from any third-party claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or the policies they incorporate, or your violation of any law or the rights of a third party.

17. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent the law allows, and the unenforceable portion will be severed. The remaining provisions will stay in effect.

18. Termination

These Terms remain in effect until terminated by you or us. You may terminate them at any time by notifying us or by no longer using the Service. If we believe you have failed to comply with these Terms, we may terminate them at any time without notice and deny you access to the Service. You remain liable for all amounts due up to the date of termination. Obligations incurred before termination survive it.

19. Entire agreement

These Terms, together with the policies posted on this site, are the entire agreement between you and us regarding the Service, and supersede any prior agreements, communications, or versions of these Terms. Our failure to enforce any provision is not a waiver of it. Ambiguities in these Terms will not be interpreted against the drafting party.

20. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Except where prohibited by consumer protection law in your country of residence, disputes will be resolved exclusively in the state or federal courts located in San Diego County, California. Nothing in these Terms limits any non-waivable rights you have under the consumer laws of your country of residence.
